Visa allocation and higher wages will not be linked anymore or at least until October 2022, wherein a hearing on this mandate given out during the Trump regime would be reconsidered! The US District Court has vacated the Trump rule that made it mandatory for the sponsors of this Visa to hire skilled professionals on higher wages considering the immigrants' skills and the geographical region. A hearing on this is going to be made on December 31, 2021. Had the new mandate come into existence, the H-1B Visa Selection would have been implemented from the next fiscal year, i.e., October 1, 2022.

Repealing this mandate is considered because Mr. Chad Wolf (now the Acting Secretary Department of Homeland Security-DHS) was not officially appointed to the office then.

H-1B Visa is not designed for immigration. However, under the auspices of this Visa, a skilled person can undertake meaningful employment in the US for six years.

So, all the skilled professionals who want to land in the US ‘only’ through a sponsor can continue doing so until a hearing that would be made soon.

Immigration attorneys were highly dissatisfied with the new law suggested by Mr. Trump. They thought it would have a 'disastrous effect' on start-ups, non-profits, rural sector undertakings, and many more businesses who cannot afford to pay high wages to their personnel. At the same time, these industries rely heavily on a highly-skilled workforce. Under the Trump mandate, even the skilled freshers just out of University will find it difficult to gain employment in the US.
