So, what’s this all about?

The H-1B visa is a golden ticket to highly skilled foreign workers to travel to the US. It was in the eye of a storm since Trump’s presidential campaign. He embarked on his journey of “Make America Great Again” campaign and his administration proposed several changes to the program to restrict foreign workers from entering the US. It was a very hard hit on the entire world and the decision wasn’t accepted all over, even by some of Americans too serving their government.

Implementing a regulation raising the wage cap of prevailing H-1B & other visa wages from May 14, 2021, to Nov 14, 2022 was also delayed by the US labor department.

There had been a lot of discussions and protests against this decision but Mr. President didn’t budge from his decision on immigration policy. Finally, once his term ended and he wasn’t re-elected, the whole world waited with a baited breath on what decision Joe Biden would be taking.

It turned to be affirmative and the legal immigration agency of the US, the US Citizenship and Immigration Services (USCIS), said the DHS issued a final rule that removes an interim final rule (IFR) issued in October 2020, which has since been vacated by a federal district court, from the Code of Federal Regulations (CFR).

According to the latest US immigration news, the US Department of Labor IFR also changed the way it calculates prevailing wage rates and adjusted the prevailing wage percentiles for some levels of H-1B visa applicants.

The change comes as a relief for Indian information technology firms, which are among the largest users of such visas. Indian IT firms regularly keep sending their employees off-shore and due to this decision by the Biden government, the hopes fly high again!
